Terms of Service
These Terms set the rules for using Foilr. What we provide, what you can do, what we're responsible for, and the limits on both sides. We've kept the language plain where we can. The full text below is what governs in the event of a dispute.
01Acceptance
These Terms of Service (the "Terms") form a binding agreement between you and Anastase Hélaine, the operator of Foilr (the "Service", available at foilr.gg and through Foilr's application surfaces). By creating an account, visiting the Service, or otherwise using it, you accept these Terms and the Privacy Policy. If you do not accept them, do not use the Service.
We may update these Terms. Material changes are communicated under Section 13.
02What Foilr is
Foilr is an independent, fan-run radar that watches the One Piece Trading Card Game market and helps collectors, players, and investors understand price moves, release schedules, and product availability. Pokémon and Magic: The Gathering coverage are planned.
Foilr is not affiliated with, endorsed, or sponsored by Bandai, the ONE PIECE Card Game, The Pokémon Company, Wizards of the Coast, or any retailer linked from the Service. All trademarks and product names belong to their respective owners.
The Service provides information and analysis about a hobbyist market. It is not financial, investment, tax, or legal advice.Prices and availability change; the secondary market is volatile; collectibles can lose value. Any decision you make based on Foilr's content is your own.
03Eligibility
To use the Service you must:
- Be at least 13 years old (or 16 if you live in the European Economic Area, the United Kingdom, or Switzerland).
- Have the legal capacity to enter into a binding agreement.
- Not be barred from using the Service under any law applicable to you.
- Not be a competitor of Foilr accessing the Service in order to build a competing product, except as expressly permitted by law (e.g. research and benchmarking).
If you create an account on behalf of an entity, you represent that you have authority to bind that entity to these Terms.
04Your account
You may create an account to access certain features. When you do:
- Provide accurate information and keep it current.
- Keep your password (or any third-party authentication you use) confidential. You are responsible for activity on your account.
- Use a unique, strong password. Do not reuse a password you use elsewhere.
- Notify us promptly at hi@foilr.gg if you suspect unauthorised access.
- Do not impersonate any person, misrepresent your affiliation, or create accounts to evade a suspension.
You may delete your account at any time from Profile → Data in the app, or by emailing us. Deletion removes your personal data per Section 8 of the Privacy Policy.
05Acceptable use
You agree not to:
- Use automated means (bots, scrapers, crawlers, mass downloaders) to access, copy, or extract Service content, except for clearly permitted web search engine crawlers respecting
robots.txt. Public AI crawlers are explicitly allowed by ourrobots.txtfor indexing. - Reverse engineer, decompile, or disassemble the Service, except where applicable law expressly permits it.
- Circumvent, disable, or otherwise interfere with the Service's security or access controls.
- Use the Service or our affiliate links to commit fraud, click fraud, or money laundering.
- Resell, sublicense, or commercially exploit the Service or its data without our prior written consent.
- Use the Service to send unsolicited communications, malware, or any harmful code.
- Use the Service to harass, threaten, defame, or violate the rights of any person.
- Use the Service to violate any applicable law, regulation, or third-party right.
- Use the Service to train any commercial machine-learning model where the training output competes with the Service, except where applicable law expressly permits such training under a text-and-data-mining exception that you have not opted out of (we reserve our rights under Article 4 of EU Directive 2019/790; this Section constitutes a machine-readable opt-out reservation in addition to the
noaidirectives in our headers and metadata).
We may suspend or terminate access for any violation. Repeat violations result in permanent termination.
06Your content
When you submit information to the Service (your collection, decks, notes, calendar items, expenses, collectively the "User Content"), you retain all rights you have in it.
You grant Foilr a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, transmit, display, and adapt your User Content solely as needed to operate, secure, and improve the Service for you. We do not claim ownership and we will not publish your User Content publicly or sell it to third parties.
You represent that you have the necessary rights to grant this licence and that your User Content does not violate any law or third-party right.
07Our intellectual property
The Service, including the Foilr name, logo, mark, design, code, original editorial content, and the structure and selection of data, is owned by the operator and protected by intellectual property laws.
Third-party trademarks (including ONE PIECE Card Game, Pokémon, Magic: The Gathering, retailer marks, and others) appear on the Service for identification and fan coverage only. Their use does not imply any endorsement by or affiliation with the trademark owners.
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own non-commercial use. All other rights are reserved.
08Affiliate links and disclosure
The Service contains affiliate links. For example, to TCGplayer, eBay, Amazon, GameNerdz, Hobbiesville, and similar retailers. When you click an affiliate link and complete a qualifying purchase, the retailer pays us a commission. The commission does not change the price you pay.
We disclose every paid relationship inline next to the link in question. Our editorial choices (what we cover, recommend, or flag as risky) are not influenced by commission rates. We never weight an opportunity higher because the affiliate path pays more.
Foilr also operates its own storefront (Foilr Shop). Shop products are labelled and are never weighted in the radar against external sources.
09App Store and Google Play
If you download or use a Foilr mobile application obtained through Apple's App Store or Google Play (each a "Store"), the following additional terms apply:
Apple App Store (iOS)
- These Terms are between you and the operator only. Apple Inc. is not a party to these Terms and is not responsible for the Foilr iOS application or its content.
- The licence granted to you in Section 7 (Our intellectual property) is further limited to use on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the iOS application. Any maintenance and support we choose to provide is at our discretion.
- To the maximum extent permitted by law, Apple has no warranty obligation whatsoever with respect to the iOS application. If the application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Beyond that, Apple has no other warranty obligation, and we are responsible for addressing any claims you or any third party may have relating to the iOS application or your use of it.
- Apple is not responsible for addressing claims that the iOS application or your possession and use of it: (i) infringe a third party's intellectual property rights; or (ii) violate any law or third-party right.
- You represent that you are not located in a country subject to a US-Government embargo, or that has been designated as "terrorist supporting", and that you are not listed on any US-Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
Google Play (Android)
- These Terms are between you and the operator. Google LLC is not a party to these Terms.
- Your use of the Android application is also subject to Google Play's Terms of Service.
- Refunds for the Android application are handled by Google according to its refund policy.
Store-managed billing and refunds
If you make any purchase through a Store (one-time purchase or subscription), the Store handles billing, taxation, and refunds according to its own policies. Refund requests for Store-billed transactions must be made through the Store, not to us. We are not responsible for transactions processed by a Store.
10In-app purchases and subscriptions
As of the effective date of these Terms, the Service is offered free of charge for individual use. Premium features and subscriptions may be introduced in the future. When they are, the following apply:
- Pricing. Prices are shown in the Service or the relevant app store before purchase. We may change pricing for future billing periods on at least 30 days' notice.
- Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel before renewal. Cancellation takes effect at the end of the current billing period.
- How to cancel. Cancel from your account settings in the Service, from your Apple ID subscription settings, or from your Google Play subscriptions page, depending on where you purchased.
- Refunds. Refunds for purchases made directly through the Service follow the consumer-protection rules of your jurisdiction. Refunds for purchases made through an app store are handled by that store.
- EU / UK withdrawal right. Where applicable, consumers in the EU and UK may exercise their statutory right of withdrawal within 14 days of purchase. By starting to use a digital service immediately upon purchase, you expressly waive the right of withdrawal for digital content already delivered to you, as permitted under Article 16(m) of EU Directive 2011/83.
11Third-party services
The Service interoperates with third-party services (authentication providers, retailers, social platforms, payment processors if and when added). Your use of those services is governed by their own terms. We are not responsible for them, their availability, or their actions.
12Disclaimers
To the maximum extent permitted by applicable law, the Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted operation.
We do not warrant that prices, availability, release dates, card content, or any other data presented on the Service will be accurate, complete, or current. The TCG market changes constantly and third-party sources are not always correct. You assume the risk of any decision you make based on the Service.
Nothing in these Terms excludes or limits liability where exclusion or limitation is not permitted by applicable law. This includes, for consumers in the EU,, your statutory rights under the conformity and remedies regime of Directive (EU) 2019/771.
13Limitation of liability
To the maximum extent permitted by applicable law:
- The operator, its affiliates, and its personnel will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business opportunity, or goodwill, arising out of or in connection with the Service.
- The operator's total cumulative liability arising out of or in connection with the Service is limited to the greater of (a) €100 EUR, or (b) the amount you paid us (excluding taxes and third-party fees) in the 12 months preceding the event giving rise to liability.
These limits apply on any theory of liability (contract, tort, statute, or otherwise), even if we have been advised of the possibility of such damages and even if a stated remedy fails of its essential purpose.
If applicable law does not allow some or all of these exclusions or limitations, they apply to you only to the extent permitted.
14Indemnity
You agree to indemnify, defend, and hold harmless the operator, its affiliates, and its personnel from and against any third-party claim, demand, loss, liability, damage, or expense (including reasonable legal fees) arising out of or related to: (i) your breach of these Terms or applicable law; (ii) your User Content; (iii) your misuse of the Service; or (iv) your violation of any third-party right.
We may assume the exclusive defence and control of any matter you would otherwise indemnify, and you agree to cooperate with our defence. You may not settle any claim without our prior written consent.
15Termination
You may stop using the Service or delete your account at any time.
We may suspend or terminate your access, with or without prior notice, if you violate these Terms, if your use exposes us or others to legal or operational risk, or if we discontinue the Service.
The following sections survive termination: What Foilr is, Your content (licence wind-down), Our intellectual property, Disclaimers, Limitation of liability, Indemnity, Governing law and disputes, and any other provision that by its nature should survive.
16Changes to these Terms
We may modify these Terms from time to time. When we make a material change, we will update the Effective date and post notice on the Service for at least 30 days before the change takes effect. If you have a registered account, we will also email you a summary.
Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you may delete your account before the change takes effect.
17Governing law and disputes
These Terms are governed by the laws of France, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
If you are a consumer resident in the European Economic Area, the United Kingdom, or Switzerland, you remain entitled to the mandatory consumer protection rules of your country of residence, and you may bring proceedings in the courts of your country of residence. The European Commission's Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.
Any dispute not resolved informally will be submitted to the competent courts of Paris, France, except where mandatory consumer or jurisdictional rules require otherwise. Before initiating any proceeding, you agree to first contact hi@foilr.gg in good faith to attempt to resolve the matter.
When the operator transitions to a US LLC (see Section 1 of the Privacy Policy), this Section will be updated to designate Delaware law and US courts, with EU/UK consumer protections preserved. You will be given 30 days' advance notice of that change.
18Miscellaneous
Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and the operator regarding the Service and supersede any prior agreements.
Severability. If any provision is held unenforceable, the remainder remains in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
No waiver. Our failure to enforce any right under these Terms is not a waiver of that right.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law, on notice to you.
Force majeure. Neither party is liable for delay or failure caused by circumstances beyond reasonable control.
Notices. Notices to us go to hi@foilr.gg. Notices to you may be sent to the email associated with your account or posted on the Service.
